Terms of Service
Zwei Dinge fehlen in diesem Dokument und müssen ersetzt werden, bevor die Seite beworben oder etwas verkauft wird:
1. Postanschrift. Nach österreichischem ECG §5 und DSGVO Art. 13 muss ein identifizierbarer Verantwortlicher mit Straße, PLZ und Ort genannt sein. Eine bloße E-Mail-Adresse genügt nicht.
2. Gewerbeanmeldung. Der regelmäßige Verkauf von Trainingsplänen und Coaching gilt in Österreich in der Regel als gewerbliche Tätigkeit. Das ist keine Rechtsberatung — kläre mit der WKO oder einer Steuerberatung, welche Gewerbeberechtigung du brauchst, bevor du den ersten Verkauf tätigst.

Payment and invoicing are handled by Lemon Squeezy as merchant of record. Your purchase contract for payment purposes is with them; the coaching itself is delivered by us.
2. What this site is
Gergö Gains provides training and nutrition guidance, including an automated plan builder that runs entirely in your browser. It is an information and coaching service. It is not a medical service.
3. What you get
Deliverables are as described on the pricing section at the time of purchase:
- The Plan — $19. Weeks 2 to 8 of your generated programme: the progression, the reps-in-reserve schedule, both deload weeks, exercise substitutions for your equipment, and a PDF. Delivered by email within 24 hours, not instantly — it is sent by a person, not a server. Your FFMI, weekly volume targets and the whole of week 1 are free on the site and require no purchase.
- The Blueprint — $99. The above plus a personal review, one 45-minute video call, a hand-tuned program, a form check and a week-4 review. We contact you by email to schedule.
- The Commission — $249. A bespoke 16-week build with three calls, fortnightly reviews, unlimited form checks, nutrition structuring and priority messaging. We contact you by email to begin.
Calls are scheduled by agreement. If you do not respond to scheduling emails within 14 days we may treat the coaching element as delivered.
4. No guaranteed results
Training outcomes depend on adherence, sleep, nutrition, genetics, training history and other factors outside our control. Nothing on this site is a promise of a specific weight, body-fat percentage, physique or timeline. Examples and photos are illustrative of one person's results, not typical outcomes.
5. Health and your responsibility
You confirm you are medically fit to train. Consult a physician before starting, especially with any injury, cardiovascular, metabolic or musculoskeletal condition, or if pregnant. Stop and seek help if you experience pain, dizziness or chest discomfort. You accept that resistance training carries an inherent risk of injury and you train at your own risk.
6. Your account and conduct
Provide accurate information — the plan is only as good as its inputs. Do not misuse the site, attempt to disrupt it, or use it for anything unlawful.
7. Intellectual property
All content, plans, text, photographs, video and code on this site belong to Gergö Szittyai. Your purchase grants you a personal, non-transferable licence to use your own plan and materials. You may not resell, redistribute, publish or share them, or use them to train a competing service.
8. Coaching materials you send us
If you send photos or video for a form check, you grant us permission to use them solely to coach you. We will not publish them without your separate written consent.
9. Cancellation and refunds
See the Refund Policy, which forms part of these terms.
10. Liability
Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability arising from your purchase is limited to the amount you paid. We are not liable for indirect or consequential loss.
11. Consumer rights and governing law
If you are a consumer in the EU, your statutory rights are unaffected by these terms. Austrian law applies and the mandatory consumer protections of your country of residence continue to apply. The EU Online Dispute Resolution platform is available for consumer disputes.
12. Changes
We may update these terms. The version in force is the one published when you purchase.
